Background
This project aims at building the capacity of the Lebanese Ministry of Justice in environmental legislation and enforcement, a priority sector for both UNDP and the World Bank. Lebanon has recently experienced an important progress in environmental policy and legislation development and application. Several key environmental legislations have been adopted by the parliament since the year 2000 which is a good indicator of the environmental maturity of the country and its efforts towards sustainable development; however, the enforcement of such legislation is what determines whether it has an effective impact on the environment or not. In Lebanon, the level of enforcement is very limited and almost nonexistent. This is due to the very weak capacity and institutional setup of the Ministry of Justice and the overall Lebanese Judiciary system.
The project main objective is to enforce environmental legislation by enforcing the capacity and institutional setup of the Ministry of Justice and the overall Lebanese Judiciary System.
Achievements & Expected Results
Review existing cases of environmental jurisprudence per sector in Lebanon, compare them to international case studies and develop a reference guide for Judges:
- The methodology and work plan for this output was proposed and established.
- 469 cases of Lebanese environmental jurisprudence identified out of 100,000 published jurisprudences.
- 5996 cases of unpublished Lebanese environmental jurisprudence were identified.
- 57 cases of French environmental jurisprudence identified out of 1000 cases reviewed.
- The first draft of the pilot chapter on industry and environment was reviewed and finalized.
- The first draft of the chapter on the Construction sector was submitted
Introduce an environmental course at the Institute of Judicial Training at the Ministry of Justice:
- Collection of all environmental law courses offered at the Lebanese universities.
- The Council of Directors of the Judicial Training at the Ministry of Justice signed an official document declaring the introduction of the course in the curriculum of the institute.
- Conducted reviews of all environmental law courses offered in national universities.
- Conducted an assessment of all existing national legislation in the context of environmental law courses for judges.
- Finalization of the course syllabus.
Raise awareness and ensure wide dissemination of information:
- Brochures designed and printed.
